The will may set out whether or not an executor will be paid for acting as an executor. This is also regulated by legislation. Unless the will says otherwise, the executor is entitled to charge up to 5% of the gross value of the estate plus out of pocket expenses. The amount charged by the executor must be approved by the beneficiaries, or if they will not approve, then the amount must be approved by the court.
